Overview
These Terms of Use (“Terms”) form a legally binding agreement between you (“you”, “your”, or “user”) and the service provider operating the application (the “Company”, “we”, “us”, or “our”).
The Terms govern your access to and use of Plantify — Plant Identifier (the “Service”), including any features, content, and subscription offerings. By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Scan
You photograph a plant or pick an existing picture of one.
Recognise
A machine learning model proposes a species with a confidence figure.
Confirm
Where the match is uncertain, you choose between the candidates offered.
Keep
The plant and its care card are saved to your garden if you want them.
You keep ownership of every photo you submit. Submitting one grants us nothing beyond the narrow permission needed to carry out the recognition you asked for and return the result to you, as described in the Privacy Policy.
You confirm that you are entitled to submit each photo. Gardens and balconies belong to someone, and people wander into frames. If your photo captures a person or private property, whether you were entitled to take it is a question of local law, and answering it is your part, not ours.
Care cards, descriptions, and answers from the plant assistant are general reference material about a species, assembled with the help of machine learning models. They are not tailored to your particular plant, your climate, your soil, or the season you are in.

Accuracy & safety
Plant recognition from a photograph is probabilistic. Many species look alike, several dangerous plants closely resemble harmless ones, and lighting, angle, damage, and season all change what a model sees. The confidence figure shown with a result is an estimate of certainty, not a guarantee, and a high figure can still accompany a wrong answer.
Do not rely on the Service for any decision where a mistake would matter. In particular, never eat, brew, apply to skin, or otherwise consume any plant, mushroom, berry, or part of one because the app identified it. Never allow a child or an animal near a plant on the strength of an identification, and never treat a poisoning or an allergic reaction using information from the app.
Notes about toxicity or safety for pets shown on a care card describe the species the model proposed. If that proposal is wrong, the note is wrong with it.
If you suspect that a person or an animal has swallowed or reacted to a plant, contact a doctor, a poison control centre, or a veterinarian immediately. Do not wait for the app, and do not let what it says delay you.
For anything that carries risk — foraging, planting near children or animals, treating a diseased plant with chemicals, or a species you cannot confirm — consult a botanist, a horticulturist, a veterinarian, or another qualified person. The Service is an aid to curiosity and everyday plant care, and nothing in it is professional botanical, medical, or veterinary advice.

Subscriptions
The Service may offer paid subscriptions that provide access to premium features. Plans (for example, weekly, monthly, yearly, or lifetime where available) may vary by region and can change over time. Current options and pricing are shown inside the app at the time of purchase.
A number of features work without payment. Unlimited recognitions, care plans, reminders, and the plant assistant belong to a paid plan. How many free scans you get, and what a plan includes, is shown on screen before you subscribe; these figures are not fixed and we may change them as the app grows.
Free trials
Some subscriptions may include a free trial. Unless you cancel before the trial ends, the subscription may convert to a paid plan and renew as described below.

Billing & renewal
Payments for subscriptions are processed through your Apple ID account (App Store) where applicable. Your account will be charged once you confirm the purchase.
Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in iOS: Settings → Apple ID → Subscriptions.
Deleting the app does not cancel a subscription. Cancellation is handled through your Apple ID settings.

Refunds
Purchases and subscriptions are processed by Apple (App Store), and refunds (if any) are governed by Apple's policies and procedures. We do not process payments directly.
In connection with a refund request, Apple may ask us to provide limited subscription-related information for verification. This may include usage signals that help confirm the subscription status (for example, whether premium features were accessed). We respond only as required to support Apple's review.
For refund requests, please use Apple's official flow in your App Store / Apple ID settings.

Acceptable use
You agree to use the Service only in compliance with applicable laws and regulations. You must not:
Use the Service for unlawful, harmful, or fraudulent purposes;
Submit photos you have no right to use, or photograph another person or their property in a way that invades their privacy;
Submit sexual imagery of any kind, and above all anything that sexualises or exploits a child;
Use the Service to identify plants for an unlawful purpose, including the cultivation, harvesting, or trade of controlled or protected species;
Feed the scanner through a script, a bot, or any tool that fires requests faster than a person could, or work around the limits on how many scans a plan allows;
Reverse engineer, decompile, or attempt to extract source code except where prohibited by law;
Use the Service in a way that infringes the rights of others.
Serious or repeated breaches may result in loss of access without refund.

Intellectual property
The Service, including its software, design, text, graphics, logos, care content, and underlying technology, is owned by or licensed to the Company and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Disclaimers
The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
Recognition depends on our processing infrastructure and on third-party model providers, so the feature may be slower, restricted, or temporarily unavailable, and an individual request may fail without a result being produced. We do not warrant that any identification is correct, that a care card suits your particular plant, or that a reminder will arrive on time.
Reminders are a convenience and not a substitute for looking after your plants yourself. Notifications may be delayed or missed for reasons outside our control, such as device settings, battery mode, or system behaviour.

Limitation of liability
Except where the law does not allow it, we do not answer for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill, arising from or related to your use of the Service, including any reliance you place on an identification, a care card, or an answer from the plant assistant.
Where liability cannot be excluded, it will be limited to the minimum extent permitted by applicable law. Where permitted, our total liability related to the Service will not exceed the amount paid by you for the Service during the preceding twelve (12) months.

Changes to these Terms
We may update these Terms from time to time. If we make changes, we will update the “Last updated” date above and may provide additional notice within the app or on our website where required by law.
Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

Termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or if required to do so by law. You may stop using the Service at any time by uninstalling it from your device.
